NFT Collector Terms

These NFT Collector Terms ("Terms") apply to non-fungible tokens ("NFTs") issued by Binyamin Laukstein ("Creator"). Creator NFTs are unique digital assets representing or associated with the Creator's physical and digital artworks ("Artworks"). By purchasing, receiving, or otherwise holding a Creator NFT, you agree to these Terms and to the applicable terms and conditions of any marketplace where you transact (including, where applicable, any "NFT Terms" referenced by that marketplace).

For clarity, "Artwork" includes the underlying creative work and any digital representations, images, previews, thumbnails, metadata, or visual derivatives associated with the NFT, regardless of resolution or format.

    Creator NFTs are minted on Creator-owned ERC-721 smart contracts:

    Because these are Creator-owned contracts, Collections and NFTs may appear on multiple marketplaces, including:

    Marketplaces are independent third-party services and have their own terms and policies. Nothing in these Terms:

    • gives you any rights against a marketplace beyond what that marketplace's own terms provide; or
    • limits any license or permission the Creator separately grants to a marketplace (and its service providers) to host, cache, index, reproduce, modify for formatting, promote, or display the NFTs and Artworks in connection with operating, marketing, or improving that marketplace.

  3. Storage

    Where possible, NFT metadata and associated media are stored on Arweave, a decentralized storage protocol designed for long-term or permanent data availability. The Creator does not operate or control Arweave or other third-party storage providers and cannot guarantee their continued operation or availability.

  4. Digital Signature

    Single-edition NFT images larger than 8×8 pixels contain a Digital Signature: a 1×1 pixel of approximate gold color #FFD700 placed 8 pixels inward from the bottom-right corner of the image (color may vary slightly due to compression). An NFT representing a physical Artwork is not an exact one-to-one digital duplication of the physical piece, and ownership of the NFT does not include ownership of the physical Artwork.

  5. Warranty

    The Creator represents and warrants that they own or control the copyrights in the Artworks associated with Creator NFTs and that such NFTs are minted under the contracts listed in Section 1.

  6. License Grant

    For as long as you lawfully own a Creator NFT, the Creator grants you a limited, worldwide, non-exclusive, transferable license to the Artwork associated with that NFT solely to:

    • access and view the Artwork, for your personal, non-commercial use, through compatible services that lawfully display the NFT and its metadata (such as supported marketplaces, blockchain explorers, wallets, and the Creator's official websites/apps); and
    • share links/URLs to such official pages where the NFT is displayed.

    This license does not allow you to:

    • download, save, copy, screenshot, scrape, reproduce, or extract the Artwork (including via automated tools or high-resolution previews), other than transient or cached copies that are technically necessary for normal on-screen viewing through compatible services;
    • upload, host, re-post, mirror, or distribute the Artwork anywhere;
    • create any physical reproductions of the Artwork;
    • use the Artwork outside platforms that lawfully display the NFT;
    • use the Artwork to train or improve machine-learning models, AI systems, datasets, or generative algorithms.

    If you sell, transfer, or otherwise dispose of the NFT, this license automatically transfers to the new lawful owner, and your rights under this Section 6 terminate.

    All intellectual property and copyright in the Artworks remain with the Creator. You do not receive ownership of the Artwork itself, nor any rights beyond those expressly granted in these Terms.

  7. Restrictions

    You agree not to:

    • use the NFT or Artwork in any way that is unlawful, defamatory, harassing, abusive, fraudulent, racist, hateful, vulgar, cruel, illegal, or obscene, or that promotes such activity;
    • download, save, copy, capture (including screenshots), reproduce, extract, or scrape the Artwork, except as technically necessary for normal on-screen viewing through compatible services;
    • upload, host, mirror, re-post, or otherwise distribute the Artwork on any platform, including websites, social media, avatars, banners, wallpapers, or messaging apps;
    • trademark, duplicate, imitate, modify, distort, reverse-engineer, or create derivative works based on the Artwork;
    • mint, issue, or create any additional NFTs using the same Artwork or any derivative of it;
    • create, sell, or distribute physical reproductions of the Artwork (e.g., prints, posters, canvases, merchandise, clothing, books, or similar items);
    • use the Artwork to market, advertise, or sell third-party products or services;
    • use the Artwork for training or improving AI, machine learning datasets, neural networks, or automated systems;
    • make any commercial use of the Artwork, except for resale or transfer of the NFT itself;
    • impersonate the Creator or misrepresent any affiliation, sponsorship, or endorsement;
    • misrepresent the rights associated with the NFT when listing or reselling it;
    • attempt to circumvent Creator royalties or attribution where such royalties/attribution are supported by a marketplace or smart contract;
    • challenge the Creator's copyright ownership of the Artwork.

    Automatic thumbnail previews created by third-party platforms when sharing a link to an official NFT page are permitted, provided you do not manually upload the Artwork.

    Standard search-engine indexing and caching of official NFT pages are also permitted, to the extent they occur automatically as part of lawful crawling of those pages.

    These restrictions apply to you and do not limit any rights or licenses the Creator may grant directly to marketplaces, infrastructure providers, or other third parties, nor do they prohibit copies made automatically by such services as technically necessary to operate (for example, caching, resizing, indexing, or streaming the Artwork).

  8. Disclaimers

    Your access to and use of the NFT are at your own risk. To the fullest extent permitted by law, the Creator makes no warranty or representation regarding:

    (a) the completeness, accuracy, availability, timeliness, originality, security, or reliability of the NFT or metadata;
    (b) compatibility with any system, device, blockchain, wallet, hardware, or marketplace;
    (c) whether the NFT will meet your requirements or be uninterrupted, secure, or error-free;
    (d) the deletion of, or failure to store or transmit, any NFT data.

  9. Limitations of Liability

    To the fullest extent permitted by law, the Creator shall not be liable for any indirect, incidental, special, exemplary, consequential, or punitive damages (including loss of profits, business interruption, loss of data, or procurement of substitute goods) arising out of or relating to your NFTs or these Terms.

  10. Protection

    To avoid fraud, you should verify that any NFT claiming to originate from the Creator:

    • is minted from the Contracts listed in Section 1;
    • includes the expected Storage and, where applicable, the Digital Signature;
    • matches information published by the Creator on official channels.

  11. Termination of License

    If you breach these Terms, the license granted to you in Section 6 terminates automatically and without notice.
    You remain the technical owner of the NFT on-chain unless you transfer or burn it, but you no longer have any right to view, access, or display the Artwork beyond what is unavoidably cached as part of normal device or browser operation.

  12. Source of Truth

    The relevant blockchain contract is the primary source of truth for the ownership and status of NFTs.
    This website (laukstein.com) is the authoritative source for the latest version of these NFT Collector Terms.

  13. Governing Law and Relationship to Site Terms and Marketplace Terms

    These NFT Collector Terms are governed by the laws of Israel, without regard to conflict-of-law principles.

    For your general use of laukstein.com, the site's Terms of Use apply.
    For your use of any third-party marketplace (such as Foundation, OpenSea, or Rarible), that marketplace's own terms and policies apply as between you and that marketplace.

    If any inconsistency arises:

    • between the Terms of Use and these NFT Collector Terms regarding NFT-related rights and restrictions between you and the Creator, these NFT Collector Terms prevail for those NFT-specific matters; and
    • between these NFT Collector Terms and a marketplace's terms regarding that marketplace's own rights or obligations, the marketplace's terms prevail as between you and that marketplace (but these Terms continue to govern your relationship with the Creator).

  14. Interpretation

    Headings are provided for convenience only and do not affect interpretation.
    If any provision of these Terms is found unenforceable, the remaining provisions remain in full force and effect.

  15. Updates

    The Creator may update smart-contract royalty settings, NFT metadata, or these Terms at any time. Updates take effect upon posting and do not retroactively reduce rights already granted to existing NFT holders, except as required by law.
